Agreement and eligibility
These terms govern your use of OffHisHips. By creating an account or using member features, you agree to these terms, the Privacy Policy, Community & Content Rules and Refund & Dispute Policy. You must be at least 18 and legally able to enter agreements. Keep your login secure, provide accurate information and use only your own account.

Our role
The website provides tools for members to publish profiles and listings, communicate, bid and submit purchase requests. Unless expressly identified otherwise in a listing, the individual seller is responsible for the item and its sale. The operator does not manufacture, inspect, certify, possess or ship member items, and does not guarantee a member’s identity, honesty, conduct, content, item quality or fulfillment. Moderation and age declarations are not verification or endorsements.

Member responsibilities
You are responsible for your content, permissions, listings, communications and transactions. Buyers must review details and ask questions. Sellers must have the right to sell their items, accurately describe condition and availability, state shipping information, comply with applicable law and fulfill commitments. Do not misrepresent hygiene, safety, authenticity or identity. Do not buy, sell or post anything unlawful, nonconsensual, stolen, counterfeit, involving minors or prohibited by the Community Rules.

Requests, auctions and payments
Auction bids must be made honestly. Sellers cannot bid on their own listings. A purchase request alone does not charge a buyer or mean that payment has been received. A seller’s acceptance reserves an item, subject to the parties’ agreement and the payment arrangement available. Card processing and payouts require a connected payment provider; any provider’s applicable terms and dispute processes also apply. Do not assume that the operator guarantees or insures off-platform transactions. Sellers remain responsible for taxes and any legal requirements relevant to their sales.

Fees
The current platform fee is 8% of an item’s sale price, excluding shipping, subject to the seller terms accepted when the listing is created. Fee changes apply to new listings. Displayed fee estimates do not mean a fee has been collected. Payment-provider charges, when applicable, are separate unless disclosed otherwise.

Content license and privacy
You retain rights you hold in your content. You grant the operator the limited permissions needed to host, process, resize, display and moderate that content to provide the service according to your visibility settings. This does not permit the operator or another member to disregard private-gallery restrictions, redistribute intimate content or impersonate you. Only post content you own or have permission to use.

Prohibited conduct
No harassment, threats, fraud, unwanted sexual messages, doxxing, account theft, scraping private content, malware, security bypasses or interference with the website. Do not share another person’s private or intimate content without consent. Report violations through Contact & support.

Account and content actions
The operator may review, restrict, remove content or suspend or delete accounts to address rule violations, security, legal obligations or service operation. Access may be unavailable during maintenance or technical problems. Where appropriate, contact support to ask about an action or seek review. Removal does not erase obligations or rights arising from a transaction.

Disclaimers
To the extent permitted by applicable law, the service is provided as available, without guarantees of uninterrupted access, suitability, accuracy, security or a particular outcome. You exercise your own judgment when communicating or transacting with members. No statement in these terms excludes rights or warranties that cannot legally be excluded.

Limitation of liability
To the fullest extent permitted by applicable law, the operator is not responsible for indirect, incidental, consequential or punitive losses, lost profits or opportunities, or losses arising from third-party conduct, member content, seller items, communications, shipping or off-platform arrangements. To that same extent, the operator’s total liability arising from the service is limited to the greater of US $100 or platform fees you paid directly to the operator in the twelve months before the event giving rise to the claim. These limits do not exclude liability for the operator’s fraud, willful misconduct, gross negligence or any liability that law does not allow to be limited.

Responsibility for claims
To the extent permitted by law, you agree to be responsible for reasonable third-party claims and costs caused by your unlawful conduct, content you had no right to post, or your material violation of these terms. This does not require you to cover losses caused by the operator’s own unlawful conduct.

Governing law and changes
These terms are governed by Tennessee law, subject to any mandatory rights and protections applicable where you live. Contact support first about a dispute so there is an opportunity to resolve it. We may update these terms prospectively and communicate material changes where required. If part of these terms is unenforceable, the remaining provisions continue to apply.

Digital purchases
A digital listing must describe the file format and what the buyer receives. Download access is granted only to the purchaser after a verified payment-provider confirmation. The purchase grants personal viewing and download rights, not copyright ownership, resale or redistribution rights. Sellers must have all adult-age, appearance, publication and download permissions required by law. Removed or refunded content may no longer be downloadable through the website. The operator may restrict unlawful or nonconsensual media at any time; this does not remove mandatory refund or other rights.
